PRIVACY POLICY STATEMENT

The Society for the Prevention of Cruelty to Animals (Hong Kong) (“the SPCA”, “the Society” or “We”), respects your personal privacy and is committed to fully implementing and complying with the Data Protection Principles and all relevant provisions of the Hong Kong Personal Data (Privacy) Ordinance. We endeavour to keep the personal data you provide to us confidential, accurate and secure. We only use the personal data provided to us for the purpose for which it is collected.

COLLECTION OF PERSONAL DATA

From time to time, we may collect personal data for the purpose of carrying out the Society’s businesses and operations, including the provision of services to you, you may be requested to supply data that may directly or indirectly identify you or other person(s) as an individual (“Personal Data”) such as, but not limited to, the following:

  • Your name;
  • Contact details such as email address, mailing and residential address, and telephone number;
  • Membership number and details (such as transactions conducted using your membership account);
  • Information for verification of identity, including type of identification and identification number (such as your HKID and passport number) and other related information;
  • Billing information such as your credit card number, bank account information and billing address;
  • Demographic information such as age, gender, nationality, pet information and reason(s) for being a member of the SPCA;
  • Details of transactions conducted using your account;
  • Other information required for the operational needs of the Society

Applicants who are minors (i.e. individuals under the age of 18) shall require the consent of a parent or legal guardian to join the Society. By accepting these Terms and Conditions, the minor confirms that he/she has obtained consent from his/her parent or legal guardian. The Society for the Prevention of Cruelty to Animals (Hong Kong) has the absolute discretion to refuse registration of any person as a Member.

There is no obligation for our members to provide all the data requested on the membership application form. However, failure to do so may result in the Society being unable to process your application(s) or to provide facilities and services to you.

We also make a record of the visitors to our website in order to analyse the website’s traffic and usage. We may gather some of this information by the use of “cookies” stored on computer hard drives, through which information which is stored on the visitor’s browser is retrievable by our website. We will not collect any personal data from you in these circumstances.

COLLECTION OF YOUR PERSONAL DATA

The Society for the Prevention of Cruelty to Animals (Hong Kong) (“The SPCA”, “The Society” or “We”), collects your personal data to provide our services to you and to improve customer experience. Please note that it is mandatory for you to provide personal data marked with asterisks. In the event that you do not provide such personal data, we may not be able to provide you with certain information, materials and/or your requested services.

USE OF PERSONAL DATA

The SPCA collects and holds the personal data provided by our members to facilitate the operation of our society. Your Personal Data may be used for the following purposes:

  • for processing your service requests (i.e. event registration, e-newsletter subscription, product purchase, account registration, member registration, and donation, etc.) with us and providing you with our services;
  • for administering your membership account and maintaining your records;
  • for facilitating communications between you and the Society;
  • for notifying you of changes to our services that may affect you;
  • for responding to and following up on your enquiries;
  • for enhancing your experience at the Society with programmes and offerings that are of interest;
  • for direct marketing upon obtaining explicit consent from you;
  • for communicating with you for potential support to the Society that is relevant to your interests and appropriate;
  • for conducting and facilitating promotional activities and events
  • for customising and sending contents, advertisements, notifications and other information on our websites, social media platforms and other platforms (“platforms”) based on your habits, experience, interests and preferences;
  • for administering, maintaining and improving our platforms;
  • for conducting statistical analysis, research, surveys, quality assurance, behavioural analysis and review;
  • for executing the service contracts between you and us;
  • for administering donations to the Society;
  • for complying with any legal, government or regulatory requirements;
  • for provision of veterinary services and other related services; and
  • for other purposes directly relating to any of the above.
DIRECT MARKETING

The SPCA intends to use your Personal Data for direct marketing carried out by the Society. The intended kinds of Personal Data to be used and the intended classes of marketing subjects are specified below. The Society may not use or provide your Personal Data unless exempted by the Ordinance or we have received your consent.

For the above direct marketing use, the Society intends to:

    1. use your name, contact details and demographic information; and
    2. market or promote the following classes of goods, services, support and related events and activities offered or arranged by the Society or their respective business partners:
      • donation and membership affairs;
      • fundraising and education activities;
      • volunteer or staff recruitment; and/or
      • providing information about our welfare work.

As indicated below under “Disclosure of Personal Data”, we may also share your date with third party service providers who assist us in our marketing efforts such as online and social media platforms.

If a member does not wish their personal data to be used for the purposes of direct marketing, they may exercise their “opt-out right” by ticking the relevant box below, or on the SPCA Membership Application Form or by directly contacting us at membership@spca.org.hk.

Disclosure of personal data
The personal data collected will be used by and shared among the Society for purposes as stated above. We will never sell or rent your information with any other organisations outside the Society.

Personal data will be kept confidential but may, where permitted by law or where such disclosure is necessary to satisfy the purpose or a directly related purpose for which the personal data was collected, provide such personal data to the following parties:

  • any agent, contractor or third-party service provider including companies such as IT contractors, cloud service providers, event agents and confidential documents disposal service agents, etc. in order for them to perform services on our behalf;
  • other companies that help gather your information or communicate with you, such as marketing and research companies, in order to enhance the services we provide to you;
  • partners or service providers that are involved in co-organising events with us or providing goods and services to you or fulfilling your requests.

We may also transfer your personal data outside of Hong Kong for necessary handling, processing or storage in accordance with this policy.

SECURITY OF PERSONAL DATA

The personal data provided by our members is kept securely in our computer system. All reasonable steps are taken to protect against any unauthorised access, processing, erasure or other use. Access to personal data is restricted to persons who have a need to use the data and have been trained to observe confidentiality.

RETENTION OF PERSONAL DATA

We retain the personal data provided to us for as long as reasonably necessary to provide services to our members and donors and to fulfill the original or directly related purpose for which the personal data was collected.

ACCESS AND CORRECTION OF PERSONAL DATA

Under the Personal Data (Privacy) Ordinance, individuals have the right to ascertain whether the SPCA holds any personal data relating to them, to obtain copies of such personal data, and to correct any personal data which is inaccurate or incorrect by use of a “data access request”. An individual may do this either by completing a Data Access Request Form as prescribed by the Privacy Commissioner for Personal Data, or by contacting us directly at membership@spca.org.hk.

a. This Statement may from time to time be revised or updated by the Society.

b. By using or continuing to use or participate any of our products/services/events, or providing information about the data subject himself/herself, a data subject is deemed to have accepted and agreed to the arrangements set out in and to be bound by the provisions herein.

 

This notice is written in English language and may be translated into other languages. In the event of any inconsistency between the English version and the translated version of this notice, the English version shall prevail.
